Agreement and scope
These Terms of Use govern access to trusdem.com, Trusdem accounts, APIs, reports and related business services. By accessing or using them, you agree to these terms for yourself and, where applicable, for the organisation you represent. If you lack authority to bind that organisation, do not use its account or credentials.
A signed service agreement, order form or data processing agreement may apply to an organisation. If it conflicts with these terms, the signed agreement controls for that organisation and service. Marketing pages and business discussions do not create a service commitment or amend a signed agreement.
Business access and accounts
Trusdem is provided for business and professional use. Access may require approval, an invitation and an active organisation workspace. You must provide accurate account information, keep credentials and API keys confidential, use appropriate authentication controls and notify security@trusdem.com promptly of suspected compromise.
Organisation owners and administrators control membership, roles, keys and usage limits within their workspace. Actions taken through an authorised account or API key are treated as actions of that organisation unless Trusdem has been notified of compromise and had reasonable time to respond.
Permitted use
You may use the service only for the lawful business purpose agreed with Trusdem and only with data you are authorised to process. You are responsible for your lawful basis, notices, decision policy and compliance with payment, consumer, employment, credit, sanctions, anti-discrimination and data-protection rules that apply to your workflow.
- Do not submit card numbers, security codes, passwords, authentication secrets or unrelated sensitive data.
- Do not use Trusdem for stalking, harassment, unlawful surveillance, a public or cross-merchant blacklist, or decisions based solely on protected characteristics.
- Do not bypass access controls, probe another tenant, interfere with service operation, overload sources, reverse engineer restricted components or use credentials outside their assigned environment.
- Do not copy, resell or redistribute source data, reports or service access except as expressly allowed by your agreement and the rights attached to the source.
Customer data and instructions
As between the parties, you retain your rights in data you submit. You grant Trusdem the limited rights needed to host, transmit, secure, transform and analyse that data to provide the service, follow your documented instructions and meet legal obligations. Trusdem does not acquire the right to use customer assessment data for unrelated advertising or unrestricted model training.
You are responsible for the accuracy and relevance of submitted identifiers and context. You must respond to data-subject requests and correction evidence applicable to your decisions. Trusdem will provide processor assistance and deletion controls as stated in the applicable agreement.
Assessments and reports
Trusdem returns contextual intelligence derived from the submitted data and the sources available at the assessment time. Results may contain source errors, incomplete coverage, ambiguous identity matches or model-assisted classifications. Confidence, coverage, timestamps, citations and stated limitations form part of the result and must be considered together.
An assessment is decision support. It is not proof of fraud, intent, creditworthiness or legal wrongdoing; it is not legal, financial or compliance advice; and it does not replace identity verification, sanctions screening or the review required by your own policy. You must not use it as the sole basis for a decision that produces legal or similarly significant effects for a person.
Sources and third-party services
Reports may cite official registers, technical internet records, search services, public websites and licensed providers. Third parties control their data, availability and terms. A citation identifies supporting material; it does not mean the source endorses Trusdem or guarantees the material’s accuracy.
Identity providers and other third-party services may have separate terms. Trusdem is not responsible for a third party’s independent service, but remains responsible for its own contractual and legal duties when it selects a processor.
Intellectual property and feedback
Trusdem and its licensors retain all rights in the service, software, documentation, visual design, trademarks and methods, excluding customer data and third-party source material. Subject to these terms and any service agreement, Trusdem grants your organisation a limited, non-exclusive, non-transferable right to use the service during its authorised term.
If you provide product feedback, you permit Trusdem to use it without restriction or payment, provided that doing so does not disclose your confidential information or personal data contrary to the applicable agreement.
Availability and changes
Service levels, support, maintenance, source coverage and change-notice commitments are those stated in the applicable service agreement. Trusdem may suspend access where reasonably necessary to contain a security incident, prevent unlawful use, protect another tenant or comply with law. We will limit the suspension and provide notice when circumstances permit.
We may update the public website and these terms. Material changes will be identified by a revised date and, for active customers, communicated as required by the service agreement or law. Continued use after an effective change constitutes acceptance only where legally permitted.
Disclaimers
Except for express commitments in a signed agreement, the website and service are provided on an “as available” basis. To the maximum extent permitted by law, Trusdem disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. Trusdem does not warrant that every source will be available, every identity match will be correct or every assessment will predict a later event.
Nothing in these terms excludes a warranty or remedy that cannot lawfully be excluded. Any service credits or specific warranties in a signed agreement remain unaffected.
Liability
To the maximum extent permitted by law, neither party is liable under these terms for indirect, incidental, special, punitive or consequential loss, or for lost profits, revenue, business, goodwill or data, even if advised that such loss was possible. Trusdem is not liable for a customer’s decision, unlawful instruction or use of a result outside the agreed purpose.
Where no signed agreement states a different cap, Trusdem’s aggregate liability arising from paid service use is limited to the fees paid for that service during the twelve months before the event giving rise to the claim. Liability arising only from use of the free public website is limited to EUR 100. These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of confidentiality or data-protection liability to the extent it cannot lawfully be limited.
Termination
You may stop using the public website at any time. Workspace suspension, termination, data export and deletion are governed by the applicable service agreement. Trusdem may terminate access for a material breach that is not cured within a reasonable notice period, or immediately where continued access is unlawful or creates a material security risk.
Terms that by their nature should continue—including confidentiality, intellectual property, disclaimers, liability, payment obligations and dispute provisions—survive termination.
Governing law and general terms
These terms are governed by Bulgarian law, excluding conflict-of-law rules. Courts in Sofia, Bulgaria have exclusive jurisdiction over disputes between Trusdem and a business user unless a signed agreement provides otherwise or mandatory law requires another forum.
If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining terms continue. A failure to enforce a provision is not a waiver. You may not assign these terms without Trusdem’s written consent; Trusdem may assign them as part of a reorganisation, financing or transfer of the relevant business, subject to applicable law. These terms and any incorporated signed agreement are the complete agreement for their subject matter.
